Policies

There is a “Zero Tolerance Policy” for abuse or unnecessary uses of protective action at Camp “Positive” Motivation Juvenile Rehabilitation Academy. If a staff member is found in violation of any use of protective action procedure from the Department of Juvenile Justice (DJJ), Attorney Generals Office or Commandant’s Office that staff member is immediately removed from the Academy and either reassigned, suspended, dismissed, and/or prosecuted depending on the outcome of the investigation.

Use of Protective Policy:
At times, recruits resort to physical assault against staff members while refusing to obey orders. The members of Camp “Positive” Motivation Juvenile Rehabilitation Academythat provide security and have direct contact with the recruits/residents are all certified. These members will be authorized by the Department of Juvenile Justice to Utilize Law Enforcement’s Use of Force Continuum in response to physical attack.

Use of Protective Action Policy:

Each and every use of protective action is documented per Commandant’s Office procedures as indicated below:

* An incident report is written by all members involved stating the facts prior, during, and after the use of protective action.
* The supervisor completes a protective action report indicating the recruit’s name, member(s) involved, injuries to recruit or member(s), control level used by member(s) involved, resistance level by recruit, and an overall assessment of the protective action utilized.
* These reports are then reviewed by each member in the chain of command to include:

1. Captain (Asst. Commander)

2. Major (Commander of the Security Division)

3. Major (Asst. Commandant)

4. Commandant, the Chief of Staff, and CEO

* Each use of protective action is reviewed by the Commandant’s Office and the Attorney General Administrative Investigations Office (Internal Affairs) to ensure that the use of protective action was in compliance with general orders, policies, and procedures and that the amount of protective action utilized was reasonably necessary to affect lawful objectives.
* Per DJJ procedures, verbal notification is made to the Central Communications Center of the Virgin Islands Police Department and a written report is completed.
